Markfed, Mahatma Gandhi Markfed Bhavan, Jambagh Hyderabad In pursuance to the Tender Notice inviting sealed Tenders for the supply of Zinc Sulphate 21% (ISI) under various departmental subsidy schemes through your retail network in the State of Telangana, we offer the following: 1. I/We have thoroughly examined and understood the said notice & terms and conditions in Tender Documents and I/We agree to abide by the same. 2. As required in the Para No.7 of the Tender schedule, Earnest Money Deposit in the form of Demand Draft in favour of T.S. Markfed is enclosed herewith. Sl. As specified in the Tender schedule, we herewith enclose all the required certificates according to the tender schedule. 6. I/We do hereby declare that the entries made in the tender are true and correct and also undertake that I/We shall be bound by the act of my/our authorized representatives. 7. 3 TENDER SCHEDULE FOR SUPPLY OF ZINC SULPHTE 21% (ISI) AGRICULTURAL GRADE LAST DATE FOR RECEIPT OF SEALED TENDERS UPTO PM ON TERMS & CONDITIONS 1. Sealed Tenders completely filled in all respects shall be put in an envelope duly superscribing with TENDER FOR SUPPLY OF ZINC SULPHATE 21% ISI AGRICULTURE GRADE. The envelope should be closed and sealed and addressed to the Managing Director, TS MARKFED, M.G. Markfed Bhavan, Jambagh, Hyderabad Tenders will be received either by Ordinary or Registered Post or in person on all working days up to PM on MARKFED bears no responsibility for loss or delay of tenders sent by post. 3. All the Tenders received will be opened at AM on at the Head Office of TS MARKFED located at H.No , 3 rd floor, Mahatma Gandhi Markfed Bhavan, Jambagh, Hyderabad Managing Director, TS MARKFED reserves the right to negotiate with the Tenderers on opening of the sealed tenders, if the rates offered in the tenders are not satisfactory. 5. The tenderer should enclose the demand draft drawn in favor of TS Markfed for Rs (Thousand only) towards the cost of tender document. 6. The manufacturers of the product only should participate in the tenders and having Agriculture license of TS Govt. for marketing of the product. 7. EARNEST MONEY DEPOSIT(EMD): a. Every Tender shall be accompanied by EMD for Rs.5,00,000/- (Rs. Five lakhs only) in the form of Demand Draft drawn on any Nationalized Bank in favour of TS MARKFED payable at Hyderabad. No tenders will be accepted without EMD. b. No interest is payable on the EMD. 3

4 c. EMD will be returned to all the unsuccessful tenderers after the final decision on the tender. In case of successful tender (s) the EMD shall be retained. 8. SPECIFICATIONS OF ZINC SULPHATE 21% (ISI) AGRICULTURAL GRADE (AS PER THE FCO 1985): a. Zinc Sulphate 21% (ISI) Agriculture Grade 1. Matter insoluble in water,percent by weight, maximum Zinc (as Zn), per cent by weight, minimum Lead (as Pb) percent by weight, maximum Copper (as Cu), percent by weight, maximum Magnesium (as Mg) percent by weight,maximum ph not less than Sulphur (as S) percent by weight, minimum Cadmium (as Cd), percent by weight, maximum Arsenic (as As), percent by weight, maximum 0.01 b. Compliance of FCO 1985 provisions: The tenderer should fulfill all the formalities required as per the Fertilizer Control Order, 1985 and should comply with all the provisions of the FCO. The tenderer will be held responsible for any deviations or any consequences arising out of non-compliance of the FCO provisions. 9. PACKING: 9.1 P a c k i n g specification with detailed description for Zinc Sulphate shall be quoted in the tender invariably and if failed to do so will entail rejection of the tender. 9.2 Packing should be as per the specification stipulated by the TS MARKFED i.e. the Poly woven sack in 10 Kgs, 20 Kgs and 50 Kgs packing printed / laminated HDPE Poly-woven sack. 9.3 Bagging Specifications: For 50 Kg 21 x32, 20 Kg-20 x22, 10Kg 14 x18, with handles, Mesh 12 x12. Denier 1000, gauge 100, Lamination: Weight: 50 Kgs 105 grams, 20 Kgs 70 grams, 10 Kgs-45 grms, Colour Ivory and bags super scribing details, i.e. TS Markfed Name, Zinc Sulphate 21% ISI Agriculture Grade, Batch No, Manufacture date, expire date and MRP. 10. General Terms & Conditions duly signed and stamped on each page by the Tenderer. 4

5 11. An undertaking on the letter head of the firm certifying that the information furnished above is correct and true and legally binding. 12. The Tenderers who have submitted their tender shall be bound by their offer and by the terms and conditions which will be valid up to from the date of offering the tender. 13. Managing Director, TS MARKFED reserves the right to accept/reject any or all the tenders/rates offered without assigning any reason thereof. 14. The successful tenderers will have to deposit Rs.5,00,000/- (Rupees Five Lakhs only) towards Security Deposit within (3) three working days from the date of confirmation in addition to EMD already deposited. 15. No interest is payable on Security Deposit. 16. The successful tenderer shall be required to enter into an agreement with TS MARKFED to supply Zinc Sulphate 21% under departmental subsidy schemes. 17. The tenderer must be financially sound and possess technical experience and proper successful track record. In support of evidence of his financial soundness and evidence of the experience, the tenderer shall furnish the IT returns of the firm along with the tender and required information as detailed in Annexure I, & II. 18. Preference will be given to reputed local manufacturers. 19. All or any disputes arising out of working or interpretation of this contract shall be resolved only by process of Arbitration. 20. The person authorized by Registrar of Co-operative Societies ( is Registrar for the purposes under section 61 of A.P.C.S Act VII of 1964) and act as Arbitrator and he shall decide any such reference at the instance of either party, as if it is a dispute under Section 61 of the A.P.C.S Act VII of TENDER PRICE AND CONTRACT REQUIREMENTS: 21.1 Tenderers are required to quote price of each item in figures and in words (in case of dispute the later will prevail) in the Schedule of price as 5

6 Annexure-III a n d fill in all blanks legibly and properly. Corrections, if any, shall be made out by crossing out, rewriting, signing and dating The price quoted shall be inclusive of all taxes for all kinds of packing The rate quoted in the Tender, shall be inclusive of packing, forwarding, freight, insurance, loading, unloading, storage, movement to anywhere in the State of Telangana and complete in all respects The tenderer shall fill up and sign the letter of tender and all other schedules which are included in the Tender documents Tenderers shall submit their tenders in accordance with the specifications of t h e tender documents only. Alternatives/conditions will not b e considered The Schedule of prices shall be firm and remain fixed during the entire currency of the contract and completion of all contractual obligations. Any extension of time granted by tender accepting authority to complete the supply schedule shall be subject to the condition that there will be no additional financial implication to the T.S. MARKFED. 22. DELIVERY 22.1 The r a t e s o f f e r e d should be o n FOL destinations in t h e entire State of Telangana Indents will be placed with the suppliers only after receiving the batch wise analysis reports i.e. Original Form J and Form L as per the FCO specifications. In case of duplicates, these forms should be attested by the concerned Agriculture Officer/Asst. Director of Agriculture The supplier should deliver the stocks as per the quantities and destinations given by MARKFED within three days from the date of placement of Indent by MARKFED The stocks will be accepted for distribution only after receiving analysis reports of the samples drawn at the destination point by the M.A.Os concerned confirming to the specifications of the product. 2.5 In case of variations i n t h e a n a l y s i s report from the conf i r m e d specification/or substandard, the stocks will be rejected, and the supplier is solely responsible for the action initiated by the 6

7 departmental enforcing authorities and the supplier should replace the entire stocks at his cost. 23. In the event of failure of samples drawn b y Dept. of Agriculture and seizure of stocks by the Agriculture Department enforcing authorities, the TS Markfed will be forced to seize the EMD and the Security Deposit of the contractor and shall not be released till the issue/case is resolved. The Markfed will also have right to claim any damages/expenses/additional cost incurred by them to make alternative arrangements to meet the required supplies/time schedules. 24. In the event of failure of the sample drawn from the stocks positioned by Markfed, Markfed will not be liable to take any responsibility for such sub-standard stock. Markfed shall not accept such stock having been supplied to the buyer even though the stock might have been positioned at the destinations/locations against an indent/purchase order placed by the Markfed. Further, in the event of any sample failure, the invoices raised by the tenderer in the name of the Markfed for such quantities, will become defunct, even such quantities were acknowledged by the recipients at the destination points / locations and Markfed will not be responsible for payment of such invoices. Whether the tenderer expresses explicitly through a formal communication or not or whether such invoices returned by the tenderer to the seller or not, it shall be the responsibility of the tenderer to cancel all such invoices and Markfed shall not be held for any liability either for the stocks or payment. 25. No price increase shall be entertained at any circumstances once the rate is finalized in Tender. 26. The suppliers should have one buffer stock point as indicated by TS Markfed in one centralized location and furnish the quantities available there along with preliminary analysis report for each batch separately. 27. The tenderer should see that said godowns included in their agricultural license and furnish the same. 28. Tenderers are also responsible for movement of stocks from buffer stock point to the destinations indicated by Markfed at his own cost. 29. Manufacturing licence of the product shall be enclosed. The tenderer who do not submit manufacturing licence, the tender will not be accepted. 30. The tenderer should possess valid ISI certificate and registration certificate of ISI (copies of proof to be enclosed). 7

8 31. The tenderer should possess the Agriculture licence issued by Govt. of Telangana for marketing of Zinc Sulphate 21% in Telangana. (Proof to be enclosed). 32. The tenderer sho uld p o s s e s s the requisite sales tax r e g i s tr a ti o n f or marketing of the product in the State of TELANGANA (Proof to be enclosed). 33. The tenderers who have failed to fulfill their supply contract in the past need not participate in the tender and their bids will summarily be rejected. 34. In case the tenderer refuses to accept the work order or refuses to perform the job on the rate quoted by him or increases the rates after acceptance of work order from the opening date of tender, his EMD shall be liable to be forfeited. 35. Price quoted shall be valid up to The supplier/s shall be required to take back the stocks of Zinc Sulphate 21% that will be left unsold for what so ever reason at the end of the season/contract period at their/his cost only. 37. TERMS OF PAYMENT: 37.1 All payments will be made by Cheque % payment will be made, subject to fulfilling the following conditions. i. Submission of stock receipt acknowledgement from t h e destinations. ii. Submission of analysis report, for the stock positioned, conforming to the specifications from Government notified laboratory for the samples drawn from the field by the MAO/ADA/JDAs. iii. To the extent of the quantity distributed The balance 50% payment will be released, subject to fulfilling the following conditions: i. To the extent of actual quantity distributed. ii. On receipt of the subsidy amount from the Commissioner & Director of Agriculture. 8
