2 Helping You to Choose a Mortgage OUR MORTGAGE SERVICE Choosing a mortgage may be your most important financial commitment. The Society will provide the following service: 1. Information on the different types of mortgage product we offer so that you can make an informed choice of which to take; 2. Information on a single mortgage product only, if we only offer one mortgage product or if you have already made up your mind. Before you take out your mortgage, we will confirm, in writing, the level of service given, except if your application is received via an intermediary, it is they who will assist you. The Society does not offer advice and recommendation on all products available in the market place. The Society will only accept introduced business from mortgage intermediaries who are authorised by the Financial Conduct Authority. If you have dealt with the Society through an intermediary we will tell you whether we have paid an introduction fee and how much it is. 3 IDENTIFICATION REQUIREMENTS By law we are required to confirm the name and address of each applicant. IMPORTANT The Society will seek information from one or more credit reference agency as detailed in the section headed Data Protection on page 6 of this application form. The results of this electronic check will determine the paper identification requirements which follow. Existing Members If you are an existing member of the Society, you will not usually have to show further proof of your identity if your details match our records and we can verify your signature. Non-Members If you are not already a member of the Society, you will be asked for up to two forms of identification from the Preferred Identification list below. However, for postal applications please forward two items from the list for each applicant to ensure your application is not delayed. If you do not have any of the items in the list below, please contact the Society and we will try to agree alternative forms of identification. 4 Security GENERAL INFORMATION ABOUT HOLMESDALE MORTGAGES When the Society grants a mortgage, the borrower will be required to provide a suitable property on which the Society will take a charge. A valuation will be required by an independent valuer; a scale of fees accompanies this guide. How Much Can You Borrow? On the assumption that the property is being purchased as a private dwelling for owner occupation, the basic advance is normally 75% of valuation. Purchasers who have been unable to save the whole difference between the basic advance and the purchase price may obtain higher advances provided additional security is available and they have adequate income. This usually takes one of the following forms: 1. a mortgage on other property (not necessarily owned by the purchaser - e.g. a relative); 2. an endowment policy having sufficient surrender value; 3. cash deposited with the Society by a third party (e.g. a relative). If the amount you are borrowing is more than the maximum loan the Society would normally make on the property (i.e. 75% of the property s valuation or purchase price, whichever is the lower), the Society will take additional security. This in no way affects your liability and promise to repay all monies owed to the Society in full, notwithstanding any claim that might be made by the Society in the event that the property is taken into possession and sold by the Society for less than the amount you owe. Borrowing Capacity The maximum amount that can be borrowed on mortgage will be subject to affordability assessed on your monthly net income and expenditure. The basic maximum mortgage advance is normally* 75% Loan to Value (LTV). For loans over 75% LTV up to a maximum of 90% LTV: additional security will be required*; refer to our Mortgage Department for detail. *except First Time Buyer special terms (i.e. max 90% Loan to Value). Types of Mortgage and How Payments Are Made There are two types of mortgage Repayment or Interest Only. With a Repayment mortgage, instalments are calculated to cover the interest due, plus a reduction in the capital sum advanced. You agree to repay the loan over a specified number of years. In the earlier years of the mortgage, each monthly instalment consists mainly of interest, but in time the proportion of interest in the instalment reduces too, thereby increasing the capital element in each repayment and consequently repaying the capital debt by the end of the term assuming all expected payments are made on time. In the case of an Interest Only mortgage, the Society accepts a payment representing interest; the capital element is repaid by some other means e.g.: an endowment policy which is acceptable to the Society is arranged on the life of the borrower for a sum not less than the amount of the mortgage and the monthly instalments payable to the Society cover only the interest due. In addition monthly premiums on the life policy are paid to the assurance company. The policy is assigned to this Society for the term of the loan. The capital sum is repaid at the end of the mortgage term (or previous death of the borrower) from the proceeds of the endowment policy. Other means of repaying the capital may be from the tax-free cash sum from a pension policy, personal equity plan, disposal of other assets or the mortgaged property. Any premiums associated with any of the aforementioned (to include life cover or not) are in addition to your interest payments to the Society. INTEREST RATE VARIATION The Society reserves the right to vary the quoted interest rate by giving notice in accordance with the mortgage conditions. ANNUAL PERCENTAGE RATE (APR) The APR is variable. INTEREST CALCULATION The Society charges interest from the day money is released for the mortgage completion. Thereafter interest is charged on an annual rest as at the 1 st April on the capital balance then outstanding. In respect of additional loans, interest is adjusted from the day of the transaction. Interest on capital repayments is adjusted from the day after receipt subject to any redemption interest that may apply. BUILDING INSURANCE Will be in accordance with the Society s Mortgage Conditions 2002 Clause 27. It is a requirement of this mortgage that you obtain and maintain current buildings insurance for the mortgage security throughout the mortgage term. 4

5 RIGHT TO REDEEM The borrower(s) may exercise this without prior notice in accordance with the Society s Mortgage Conditions 2002 clause 20 subject to clause 5(f) and the following item headed Early Repayment Charge. EARLY REPAYMENT CHARGE (Mortgage Condition 20). The Society reserves the right to charge up to 3 months interest on either full or partial redemptions within the first 5 years. This is reduced by one fifth for each complete year that the mortgage has been in force. Further, the value of any discounted rate concession or benefit in lieu of the concession will be recovered. Any variation to these conditions will be clearly stated in your Mortgage Offer. RIGHT OF SALE (Possession). The Society s power arises from the Mortgage Conditions 2002 clauses 13 and 14 and, should this action be taken, the Society will close the account but without prejudice to any liability under the borrower s Personal Covenant. PERSONAL COVENANT The borrower is personally liable for all sums due to the Society whether or not any security held by the Society is sufficient to meet that liability. CASES OF HARDSHIP The Society will, wherever possible, give sympathetic consideration in cases of hardship and would encourage borrowers who find themselves in financial difficulty to contact the Society immediately. If you are in difficulties, you can also get help and advice from debt counselling organisations. At your request and with your consent, we will liaise, where possible, with debt counselling organisations that we recognise, for example: Citizens Advice Bureau ; or money advice centres; or the Consumer Credit Counselling Service. GUARANTEES AND THIRD PARTY SECURITY Any person willing to act as Guarantor must be aware that they are equally as liable for the debt as the borrower which will encompass the advance plus interest and costs, including those associated with enforcement of the Society s security. Guarantors will be required to obtain Independent Legal Advice before entering into the undertaking to act as a Guarantor and we request written evidence that this has been done. CONFIDENTIALITY We will treat all your personal information as private and confidential (even when you are no longer a member). Nothing about your accounts, nor your name and address, will be disclosed to anyone, including other companies in our group, other than in four exceptional cases permitted by law. These are: Where we are legally compelled to do so; Where there is a duty to the public to disclose; Where our interests require disclosure; this will not be used as a reason for disclosing information about you or your accounts (including your name and address) to anyone else including other companies in our group for marketing purposes. Where disclosure is made at your request or with your consent. If we intend to take possession of your property, we will tell you that this information may be disclosed to credit reference agencies and that your name may be passed to other lenders by being placed on the CML Possession Register. COMPLAINTS PROCEDURE The Society operates a procedure for handling complaints fairly and speedily and we will tell you what these are. These will include establishing a set time for an initial acknowledgement to your complaint. We will tell you how long it might take us to respond more fully. If you are not satisfied with the Society s response following the completion of the Complaints Procedure you may refer your complaint to The Financial Ombudsman Service Scheme for independent arbitration. 6 CHARGES These may be made in connection with the operation of your mortgage account, some examples are as follows: (i) changing the method of repayment; (ii) administration fee on redemption of the mortgage; (iii) other charges associated with the granting of further advances, re-advances or similar and the enforcement of the Society s security; (iv) the Society s legal fees whether or not the advance is completed; (v) Assignment or Re-Assignment of policies. Details of current charges will be enclosed with your Mortgage Offer or are available on request. DATA PROTECTION ACT 1998 Any personal information which you or others provide to the Society may be held on computer and in other manual and electronic forms and may be retained for a set period, as defined in the Holmesdale Building Society Document Retention policy which may be subject to change. In considering your application we will search your record at a Credit Reference Agency. They will add to your record details of our search and your application and this will be seen by other organisations that make searches. (We do not use a credit scoring or other automated decision making system when assessing your application). Your record will be shared with other organisations and used by them to: help make decisions about credit for you and members of your household; trace debtors, recover debt, prevent money laundering and fraud. The Credit Reference Agency will also use your record for statistical analysis about credit.
