Our industry continues to evolve as we face new regulatory changes once again this year, not to mention adapting to another regulator in the CFPB as we begin to get a feel for their approach to enforcement of the regulations. On top of this we have the normal economic forces of interest rates, the housing market and competition to deal with. So, when we were looking for an appropriate theme for our annual Mortgage Bankers Association of Hawaii (MBAH) conference this year, we all agreed that lending in 2015 is very much like being a contestant or chef on a cooking show, hence this year s theme, What s Cooking with the Mortgage Industry? Much like contestants on a cooking show, we are dealing with having to be innovative in coming up with recipes for success in an ever-changing environment. 5 TERMS & CONDITIONS Exhibition Sponsor and Management. This event is produced by and is the property of Mortgage Bankers Association of Hawaii, Inc., hereafter referred to as MBAH. MBAH will provide sole management and promotion of this conference. Contract for Ad Space. Application for booth and advertisement space, upon acceptance by MBAH and payment of the full fee, constitutes a contract for space assignment. Any vendor failing to occupy space for the tradeshow by 9:00am on Thursday, July 30, 2015 shall be considered a cancellation and is not relieved of the obligation to pay full rental price. This contract will not be binding upon MBAH in the event of strikes, acts of God, or other circumstances beyond MBAH s control. In addition, the vendor agrees that its display space is to be used solely for the company whose name appears on the contract and will not sublet or assign any portion of space nor allow individuals representing other entities to be present in the booth. Assignment of Tradeshow Space. Tradeshow area will be located in Mauna Kea Ballroom on the third floor of the Hawaii Prince Hotel Waikiki. Vendors will be assigned booth locations at the discretion of MBAH. The decision of MBAH with respect to allocation of booth space will be final and binding upon all vendors. Booth Staffing. All booths must be staffed during tradeshow hours. Organizations must register all staff in advance of the conference to receive a badge that is required for entrance into the tradeshow area at all times. Staff must be at least 18 years old and is limited to a maximum of three persons per booth. Booth Setup and Dismantling. Vendor agrees to comply with the tradeshow dates and schedule. Installing or dismantling an exhibit at any other time than scheduled is strictly prohibited. The Hawaii Prince Hotel Waikiki will not accept any shipments directly to the hotel. All shipments must be coordinated through Eric Hodnefield, (808) , or via at erich@ financefactors.com. Cancellations. All cancellations require WRITTEN NOTIFICATION to MBAH according to the following guidelines: No refunds will be made for cancellations after June 30, Sponsorships for printed items (i.e., name badges, etc.,) are non-refundable once order has been placed. Liability and insurance. Exhibitor agrees to protect, save, and keep MBAH, the Hawaii Prince Hotel Waikiki harmless from any damages or charges imposed for violations of any law or ordinance, whether occasioned by the negligence of the Exhibitor or those holding under the Exhibitor, as well as to strictly comply with the applicable terms and conditions contained in all agreements between the exhibition premises. MBAH and Hawaii Prince Hotel Waikiki will exercise reasonable care for the protection of Exhibitor s materials and displays. However, the Exhibitor, on signing this contract, expressly releases MBAH and Hawaii Prince Hotel Waikiki and agrees to idemnify the same against any and all claims or such loss, damage or injury. The Exhibitor understands that neither MBAH nor Hawaii Prince Hotel Waikiki maintains insurance covering the Exhibitor s property and it is the sole responsibility of the Exhibitor to obtain such insurance. Exhibitors desiring to carry insurance on their exhibits will place at their own expense. Treatment of Convention attendees. Vendor agrees to treat all conference attendees with courtesy and not to discriminate against any person for reasons of race, color, creed, national origin, sex, sexual orientation, physical impairment, social, political, or economic condition. MBAH reserves the right to remove any exhibitor whose personnel discriminates against any persons in any manner. 5
