Bank may change the cost of credit The Bank may change the fees and charges (amount; frequency and time for payment) from time to time. You will receive at least 5 (five) business days written notice of the change from the Bank. 2. Statement of Account The Bank will deliver a statement of account to you every month. The statement of account will be delivered to you by / or ordinary mail/ printable webpage to the addresses indicated in the Quotation or the most updated information on our system. You may also request a statement from the Bank. Such requests may attract a fee. 3. Acts that will place you in default The following act will place you in default of this Credit Agreement if you do not rectify them within 15 (fifteen) calendar days of delivery of written notice from the Bank to do so Failing to pay any amount owing to the Bank when it is due on this agreement. 4. Acts that will place you in breach Any of the following acts will place you in breach of this Credit Agreement if you do not rectify them within 15 (fifteen) calendar days of delivery of written notice from the Bank to do so: Any breach of this Credit Agreement or any other Credit Agreement with the FirstRand Banking Group is committed or allowed by you or a surety (if applicable); A judgment is given against you and is not satisfied within 15 (fifteen) business days thereafter; You or any surety commit an act of insolvency mentioned in the Insolvency Act 24 of 1936, as amended; You or any surety have furnished information in your Credit Agreement application that is incorrect or you have failed to disclose material information that would have influenced the Bank's decision to grant any credit; You do or allow anything to be done that may prejudice the Bank's rights or interests; If your monthly income is not deposited to your primary cheque account linked to this Credit Agreement every month for the duration of your Credit Agreement; You or any surety are provisionally or finally sequestrated; You or any surety sell the whole or a major portion of your business or assets; and You or any sureties apply for assistance in terms of the Agricultural Credit Act 28 of 1966 as amended. 5. Steps the Bank can take if you default or are in breach If you are in default or breach of this Credit Agreement, the Bank may take the steps set out in Part C of Chapter 6 of NCA. If you are in default or breach of this Credit Agreement, then without affecting the Bank s other rights in contract or law, the outstanding principal debt plus interest (where applicable) and other fees and charges will become immediately payable as from the date of default or breach. The Bank can also at any time when you commit an act of default or breach terminate this Credit Agreement and claim the full outstanding amount you owe under this Credit Agreement immediately without affecting any of its other rights. The following process will be followed if you are in default under this Credit Agreement: The Bank will inform you of this in writing in the form of a section 129(1)(a) notice. The notice will give you at least 10 (ten) business days to do one of the following: a) rectify the default e.g. make the required payments; b) refer this Credit Agreement to a debt counsellor to develop and

2 agree on a plan to bring the payments under this Credit Agreement up to date; c) refer the matter to a registered and accredited Alternative Dispute Resolution Agent, Consumer Court or Ombudsman with jurisdiction to resolve a dispute. If you are in default for more than 20 (twenty) business days and you don t rectify the default or use the other options given to you in the section 129(1)(a) notice within the 10 (ten) business days, the Bank may take legal action against you, and if successful get a judgment against you. If this Credit Agreement is being reviewed under Section 86 of the NCA (debt review) and 60 (sixty) business days after the date on which you applied for the debt review has passed and you are in default of this Credit Agreement, the Bank may give notice to terminate this Credit Agreement from the debt review process under section 86 (10). The Bank may not terminate this Credit Agreement from the debt review process if an application for the debt review has already been filed (meaning issued by the relevant court or National Consumer Tribunal, served on the Bank and filed) at court or in the National Consumer Tribunal. 6. Default Administration Charges that will apply Default Administration Charges are charged to you by the Bank to cover administration costs it paid or must pay because you did not pay on time or at all i.e. you defaulted on any of your payment obligations under this Credit Agreement. Default Administration Charges can be charged for each necessary letter written under Part C of Chapter 6 of the NCA (Section 129(1) (a) default notice and Section 86(10) termination notice. Default Administration Charges will be equal to the amount payable for a registered letter of demand in undefended actions under the Magistrates Court Act 1944 in addition to any reasonable and necessary expenses paid or payable to deliver such letter. 7. Explanation of Collection Costs Collection Costs are charged to you by the Bank to enforce a monetary obligation under this Credit Agreement. Collection Costs incurred by the Bank to collect the debt will be limited by Part C of Chapter 6 of the NCA and the Supreme Court Act 1959; the Magistrates Court Act 1944; the Attorneys Act 1979 or the Debt Collector s Act 1998 whichever applies to the enforcement of this Credit Agreement. The Bank may claim legal costs from you on an attorney and client scale. 8. How we share and obtain information with/from Credit Bureaux The credit bureau provides a credit profile on persons and possibly a credit score on the credit worthiness of persons. You have the right to contact any credit bureau to ask for information about your credit record and to correct any information that is wrong. You agree that the Bank can share the following with the credit bureax and other divisions of the Bank: Information about your non-compliance with the terms and conditions of this Credit Agreement, Information about your application for credit; the opening of the account and your termination or our termination of this Credit Agreement. You will receive at least 20 (twenty) business days written notice of the Bank s intention to submit adverse information about you to a credit bureau. We obtain and share information with the following credit bureaux: TransUnion ITC Tel: ; Experian Bureau (Pty) Ltd Tel: ; Expert Decision Systems (XDS) Tel: ; and Compuscan Tel: For the Bank to consider your application for any FNB products or services or continue a relationship with you, you agree that the Bank may - as part of the Bank s normal checking and account maintenance processes do the following: Get certain of your personal information from any other party (e.g. a credit bureau or a government agency). Disclose some of your personal information to these parties to get the information the Bank needs. If the Bank does this the Bank will never disclose or ask for more information than the Bank needs. You and the Bank have the right to terminate the Credit Agreement You can end this Credit Agreement at any time by paying the Bank the full amount you owe ( the settlement amount ). The Bank can terminate this Credit Agreement if you are in default of your agreement. 10. Early Settlement You are entitled to terminate this agreement by settling the amount outstanding in full, in respect of your credit agreement at any time with or without advance notice to the Bank. The amount required to settle your Credit Agreement is the total of the following amounts: The total unpaid balance of your Credit Agreement at the time; and The unpaid interest charges (if applicable) and all other fees, charges and insurance premiums payable by you to the Bank up to the settlement date.

3 This Credit Agreement is not of a continuing nature and the loan amount together with the Initiation Fee (and any other fees or charges) must be fully repaid within and not later than the 31 (thirty-one) business day period from the date the loan amount was paid out to you. The Bank will give you a statement showing the settlement amount at no charge within 5 (five) business days of you requesting it. The statement of the settlement amount will be valid for 5 (five) business days after delivery. 11. You have the right to make complaints You have the right to: refer any matter or dispute including those relating to allegations of reckless lending about the Bank to an ombudsman with jurisdiction; file a complaint about any alleged contravention of the NCA or alleged reckless lending with the National Credit Regulator; make an application to the National Consumer Tribunal if allowed by the NCA. The Bank will accept any payment under this Credit Agreement when it is made even if that is before the date on which the payment is due. The Bank will credit each payment made under this Credit Agreement or in terms of a judgment granted based on the Credit Agreement as follows: firstly to cover any interest charges owing (if applicable); secondly to pay any fees or charges owing and thirdly to reduce the amount of the outstanding principal debt. Payments and early payments made and allocated will not be refunded. 13. You have the right to apply for Debt Review You have the right to apply to a debt counselor for Debt Review in the prescribed manner and form to have yourself declared over-indebted. The debt counsellor may require you to pay a prescribed application fee. The debt counsellor will notify all your Credit Providers and every registered credit bureau of the application for debt review. The debt counsellor must determine in the prescribed manner and within the prescribed time whether you appear overindebted and upon your request whether any of the Credit Agreements appear to be reckless. The debt counsellor s assessment may reveal that you are not over-indebted; experiencing or likely to experience difficulty in paying what you owe under Credit Agreements in a timely manner or are overindebted. If the debt counsellor rejects your application for debt review then you may, with the permission of the Magistrates Court, apply to the Magistrates Court to be declared over-indebted. 14. Addresses where you and the Bank will receive legal and other notices You agree that the Bank may send you any communication, which includes any document, form or notice by hand, ordinary mail, prepaid registered mail; fax; ; sms; mms; FNB Online notification; FNB App notification; printable webpage and/ or any other electronic communication method. Any section 129(1)(a) default notice or section 86(10) termination of debt review notice will be delivered to you by prepaid registered post and/ or by hand. Documents, forms, notices or processes that the Bank must by law serve on you will be served at your physical address as recorded in the Quotation. (This is your domicilium citandi et executandi address, your chosen address to receive legal documents.) Any legal notice, form, document or process you want to send to the Bank must be delivered to the following address: 3rd Floor; 1 First Place; Bank City; Corner Simmonds and Pritchard Streets; Johannesburg; Either you or the Bank may change the above addresses (to another address by giving each other written notice (by hand or prepaid registered mail) of the new address. Notice must be given of the change at least 10 (ten) business days before the change will apply. A document; form; notice or process will be treated as having been received by the party to whom it was sent: If delivered by hand during normal hours on the date it was delivered. If posted by prepaid registered mail at 10h00 on the fourth day after the post office issued the registration receipt. If posted by ordinary mail at 10h00 on the fourth day after the document is posted. If sent by fax on the date shown on the receipt the fax machine generates. If sent by or printable webpage on the date on which the notice was e mailed.

4 15. Changes to the Credit Agreement must be recorded and agreed to by both parties No changes to the terms or conditions of this Credit Agreement will be legally binding unless it is recorded, signed by both parties or voice-logged. A change to an existing Credit Agreement, or a deferral or waiver of an amount under an existing Credit Agreement, is not to be treated as creating a new Credit Agreement if the change, deferral or waiver is made according to the NCA or this Credit Agreement. 16. Your and our right to cede and delegate our rights and duties under the Credit Agreement You may not cede any rights or delegate any obligations in terms of your Credit Agreement without the Bank s prior written consent. The Bank may, at any time and without notice to you, cede, delegate or assign any of its rights or obligations in terms of this Credit Agreement. 17. You agree that the Magistrates Court will have jurisdiction Under section 45 of the Magistrates Court Act 1944 you consent to the Bank enforcing this Credit Agreement in a Magistrates Court that has jurisdiction. The Bank may still at its discretion enforce this Credit Agreement in the High Court of South Africa or any other court with jurisdiction. 18. Bank does not waive its rights While the Bank may allow you extra time to comply with your obligations under the Credit Agreement or decide not to exercise some or all of the Bank s rights under the Credit Agreement, the Bank can still insist on the strict application of any or all of the Bank s rights at a later stage. You must not assume that this means that the Bank s Credit Agreement with you has been changed or that it no longer applies to you. 19. Bank s rights to Set off your debts If the law allows, the Bank has the right, if necessary where you are in default or breach of this Credit Agreement, to do any of the following: Place any of your funds (credits) on hold until it has a discussion with you about any amount you owe the Bank; or Set-off any outstanding amounts that are due and payable against funds (credits) available in other accounts you have with the Bank. The Bank will notify you if it Sets-off funds in any of your accounts. 20. Evidence of what you owe A certificate signed by any authorised employee of the Bank (whose appointment; authority or signature the Bank does not have to prove) will be evidence of this Credit Agreement with you, your account, what you owe the Bank, the interest rate (if applicable) that applies and any other matter arising from this Credit Agreement with you, unless you can prove otherwise. 21. Affordability and Credit Assessment Under the NCA the Bank must assess if you can afford this Credit Agreement. To do this you agree that the Bank will rely on the information you gave it or the information which you confirmed as correct when you applied for this Credit Agreement. If you did not give the Bank all the information it required or if you lied or withheld information or confirmed incorrect information, the Bank has a complete defence against an allegation of reckless credit. 22. Consequences of a court finding portions of this agreement are not lawful Each and every clause of this Credit Agreement is severable from the others. This means that if any one or more of the clauses are held to be invalid, the rest of the agreement will still apply to the extent that the NCA allows for this. 23. Definitions: NCA: The National Credit Act 34 of 2005 and any amendments Business Days: Excludes Saturdays, Sundays and official public holidays 24. Headings The headings in clauses are provided for convenience only and must not be used to interpret this Credit Agreement. FNB GENERAL TERMS AND CONDITIONS 1. THIS DOCUMENT RECORDS YOUR AND OUR AGREEMENT This agreement will apply to you if you are an individual and you have any account with First National Bank (FNB). This agreement sets out the general terms & conditions that apply to your and our relationship. You can do your banking or get information about your account using different banking channels. We may also provide you with payment mechanisms like a debit, cheque or petrol card so you can transact on your account. From time to time we may also make other services available to you. All of the above (banking channels, access mechanisms and services) are governed by their own rules. These rules will also apply to you if you use these products/services. To fully understand your and our rights and duties, you must read this agreement together with those rules. You must contact us if you don t understand any part of the rules. If there is a conflict (difference) between this agreement and the rules, the rules will apply.

5 We can change this agreement or any of the rules at any time. We will tell you about any significant (important) changes to this agreement or the rules before we make the change. Unless you end the agreement before the date the change comes into effect (applies), we can assume that you agreed to the change. The words you or your means the account holder and any person the account holder allows to operate on the account. The words us, our, we or the bank only refers to First National Bank. 2. FEES YOU MUST PAY US In return for providing you with banking products and services you must pay our fees as set out in the rules and in FNB s latest Pricing Guide. (A copy is available on or from any FNB branch.) Unless we say otherwise all fees are non-refundable. We may change our fees from time to time. We will advise you of this by giving you notice of the changes within a reasonable time before the change takes effect. 3. WHEN AND HOW WE WILL SEND YOU STATEMENTS To help you to check the transactions on your account we may make account statements available to you or you can go to any FNB branch and ask for a statement. You must check your statements. Statements are not sent out on certain accounts. We may either make your statements available electronically (e.g. on online banking) or we may send you your statements by or by post. We can charge you an additional fee for statements you request over and above those we normally give our customers. Your statement will show all the transactions on your account for the period written on the statement. Transactions carried out, but not yet paid or deducted from your account will not appear on your statement 4. YOU MUST CHECK YOUR STATEMENT CAREFULLY AND REPORT ANY MISTAKES You must check each entry on your statement carefully as soon as you get your statement. You must report any mistakes or transactions done without your permission to us within 30 (thirty) days from the date of the statement. If you don t do this we can assume the entries and transactions shown on the statement were correct or done by you or with your permission. We will not be responsible for any loss or damage you suffer because you didn t report errors or unauthorised transactions on time. If you receive incontact notifications you must report any unauthorised transactions to us within 24 hours to prevent further unauthorized transactions. If you don t do this we can hold you responsible for those transactions. 5. HOW WE TREAT YOUR PERSONAL INFORMATION In this clause FSR means: FirstRand Bank Limited, FirstRand Limited, any affiliate companies, its associates, cessionaries, delegates or successors in title and / or third parties (like its authorised agents and contractors). How we use your information: FSR collect information from you directly; from your usage of our products and services; from your engagements and interactions with us; from public sources and from third parties. Your information will be confidential and will only be processed if you consented thereto; it is necessary to conclude or perform in terms of a contract with you; the law requires it or your, our or a third parties lawful interest is being protected or pursued. FSR may process your information. information includes amongst others information regarding marital status, national origin, age, language, birth, education, financial, identifying number, address, physical address, telephone number, online identifier, biometric information and your name. The processing of information includes the collection, storage, updating, use, making available or destruction thereof. FSR may process your information for the following reasons (amongst others): To comply with legislative, regulatory, risk and compliance requirements (including directives, sanctions and rules), voluntary and involuntary codes of conduct and industry agreements or to fulfil reporting requirements and information requests. To detect, prevent and report theft, fraud, money laundering and other crimes. To enforce and collect on any agreement when you are in default or breach of the agreement terms and conditions, like tracing you or to institute legal proceedings against you. To conduct market and behavioural research, including scoring and analysis to determine if you qualify for products and services. To develop, test and improve products and services for you. For historical, statistical and research purposes. To process payment instruments (like a cheque) and payment instructions (like a debit order). To create, manufacture and print payment instruments (like a cheque) and payment devices (like a debit card). To do affordability assessments, credit assessments and credit scoring. To manage and maintain your accounts or relationship with FSR. To disclose and obtain information from credit bureaux regarding your credit history. To enable you to participate in the debt review process under the National Credit Act, where applicable. To enable FSR to deliver goods or documents or notices to you. For security, identity verification and to check the accuracy of your information. To communicate with you and carry out your instructions and requests. For customer satisfaction surveys, promotional and other competitions. FSR may share your information with the following persons (amongst others) whom has an obligation to keep your information secure and confidential: Attorneys, tracing agents, debt collectors and other persons that assist with the enforcement of agreements. Debt counsellors, payment distribution agents and other persons that assist with the debt review process under the National Credit Act. Payment processing services providers, merchants, banks and other persons that assists with the processing of your payment instructions. Insurers, brokers, other financial institutions that assist with the providing of insurance and assurance.

6 Law enforcement and fraud prevention agencies and other persons tasked with the prevention and prosecution of crime. Regulatory authorities, governmental department, local and international tax authorities and other persons that FSR under the law have to share your information with. Credit bureaux. FSR s service providers, agents and sub-contractors like couriers and other persons FSR uses to offer and provide products and services to you. Persons to whom FSR cedes their rights or delegates their obligations to under agreements. FSR can process your information outside of the borders of South Africa, according to the safeguards and requirements of the law. FSR may process your information using automated means (without human intervention in the decision making process) to make a decision about you or your application for any product or service. You may query the decision made about you. You have the right to access the information FSR has about you by contacting us at FNBComplianceSupport@fnb.co.za or You have the right to request us to correct or delete the information FSR has about you if it is inaccurate, irrelevant, excessive, out of date, incomplete, misleading, obtained unlawfully or no longer authorised to be kept. You must inform us of your request. You may object on reasonable grounds to the processing of your information. You may not object to the processing of your information if you have provided consent or legislation requires the processing. You must inform us of your objection at care@fnb.co.za. You have the right to withdraw your consent which allows us to process your information; however we will continue to process your information if permitted by law. You have the right to file a complaint with the Information Regulator, once established, about an alleged contravention of the protection of your information. You can refer to our Privacy Policy (copies can also be obtained from fnb.co.za) for more information on our privacy practices. 6. YOUR AND OUR ADDRESS FOR SENDING CORRESPONDENCE AND LEGAL NOTICES We may communicate with you using any means (electronically, fax, paper). We will send any communications (including statements) to the last postal; street; address, telephone; cellphone or fax number we have on record for you or that is known. We may also communicate with you using our website, our banking channels (online, cellphone, telephone, ATM or our branches) or by means of a publication/advertisement in the media. We will serve legal notices and summonses at the last street address we have on record for you. You choose this address as your domicilium address for serving legal notices and summonses. You must send us any legal notices or summonses to the following address, which we choose as our domicilium: FNB Legal, 3rd Floor, No 1 First Place, Bank City, Johannesburg You must immediately tell us if any of your addresses, phone or fax numbers change. You can do this by contacting us, visiting any FNB Branch or by calling our call centre. (If you change your street address, you must give us proof of your new address.) It may take up to 7 (seven) days for the change to reflect on our systems. So we can update your records you agree that we may get your addresses and contact numbers from other companies in the FirstRand Limited Group. We will only use this information as stated above. Any correspondence we send to you by: post, will be considered to have been received by you within 14 days from the date on which we posted it; by fax, or SMS, will be considered to have been received by you on the day it was sent, or in the case of a Saturday, Sunday or public holiday, on the next business day. Any notices or correspondence we make available on our website, our ATM network, our branches or in the media will be considered to have been received by you on the date it was published. 7. JURISDICTION AND COSTS We can bring any action against you under this or any other agreement we have with you in the Magistrate s Court, even if the amount claimed exceeds the jurisdiction of that Court. You agree to pay all the expenses we spent in recovering any money you owe us, including, our legal costs on the attorney and client scale; collection charges; tracing fees, plus VAT. Attorney and own client scale means the rates actually charged by our attorneys. These rates may be higher than the rates the courts allow. 8. IF YOU APPOINT OTHER PERSONS TO USE YOUR ACCOUNTS YOU ARE RESPONSIBLE FOR THEIR ACTIONS If you complete the necessary bank form, we will allow another person to use your account. We refer to these persons as account users. You will be responsible for all debts account users incur including our fees and charges, any overdrawn amounts plus interest on those amounts. You will be responsible for anything they do or fail to do. There is risk involved in giving another person access to your account. You must consider if restrictions or limits must apply. You must provide correct and up to date information about the account users. You alone are responsible for deciding and checking what rights must be given to account users. You can cancel an account user s rights at any time by completing the required bank forms. You will be liable for all transactions they made before you did this, including future dated payments and cheques. The rights you gave to any account user come to an end when you end their authority or where the law says so, such as on your death or if you become legally incompetent. 9. The product supplier s products are provided under a contract between the product supplier and FNB. FNB performs binder and outsourcing functions for MMI and FirstRand Life and it collects binder and outsourcing fees for doing so. FNB takes responsibility for the actions of its authorized representatives insofar as they are providing financial services (some of whom may be providing FAIS financial services under supervision). You can request assistance from the Ombud if you believe that your complaint has not been resolved satisfactorily by us with 6 (six) weeks of lodging your complaint. You need to refer the dispute to the Ombud within 6 (six) months of the issue remaining unresolved with FNB. 10. GENERAL At certain times, FNB may be prevented from providing banking or other services, products or goods to you or its customers or fulfilling its obligations to you because of things or events that are outside of its control. This includes, but is not limited to, involuntary interruptions outside of FNBs control such as electricity failures or blackouts or the unavailability of any telecommunications system or networks. It also includes wars, fires, floods, strikes. In such cases FNB will not be responsible for any failure to perform any of its obligations to you or its customers or any person, and its obligations will be suspended, for as long as such interruptions continue. FNB may its discretion give you prior notice of interruptions and changes, but it has no duty to do so. Without limiting the clauses before, FNB will not be legally responsible to you, any customers or person for any loss, costs, expenses, damages, or any claims, lawsuit, demands, of any kind whatsoever, whether brought by an individual or any entity, because of any service interruptions that were beyond FNBs reasonable control. TAKE NOTE: FNB endeavours to stop or prevent any criminal activities including money laundering and terrorist financing. Because of this FNB can do any of the following things if it considers it necessary to do so, or if South African and international laws, rules, regulations restrictions and policies ( the laws ) require it to do so: FNB may verify (check and confirm) the identity of any customer and entity as well as that of any persons related to or acting on behalf of or involved with such customers or entities. This includes, but is not limited to, mandated persons, directors, signatories, shareholders and related entities. FNB will do this at the start of the business relationship and as often as it or the law considers necessary thereafter. FNB can refuse to do business with any person or entity that it considers undesirable. FNB will not willingly and knowingly do business with any person that appears on any sanction list as prescribed by legislation or used by it in the management of its risks or that is linked to any agencies that appear on such sanction list, or linked to any restricted countries or the government agencies of such restricted countries as determined from time to time. FNB can end its relationship with a customer. FNB can monitor any transactions and instructions. FNB can request further information before acting on any instruction or transaction. FNB can verify any transaction or instruction or recipient before processing it. This may result in a delay in FNB carrying out the instruction. FNB can refuse to carry out any instruction or transaction. FNB can place a hold on any account or facility. You agree to assist FNB to comply with the laws by providing FNB with all the information and documents it requires. If you fail to do so or provide false information FNB can refuse to enter into a relationship with you, refuse to carry out an instruction or process an instruction and can also end its relationship with you. TAKE NOTE: FNB will not be legally responsible to you, or any person, or customer for any loss or damage, you or they suffer if it does any of the things mentioned above or anything else necessary to comply with the laws. You must tell us immediately if you are placed under an administration order, are sequestrated.

8 If your estate is provisionally or finally sequestrated or if you pass away, or become legally incompetent the full amount you owe us will be payable and access to the money in your account will be restricted. If we need to take legal action against you, one of our managers (who do not need to prove his appointment) will produce a certificate, which shows the amount you owe us. If you don t agree with this certificate, you will have to prove that it is wrong. In the case of fraud, suspected fraud, or where the law forces us, we can freeze or close your account or stop a service without notice to you. If there is a dispute about any matter or record, our records (certified as correct by any FNB manager whose authority need not be proved) will serve as prima facie proof. This means it will be treated as correct unless you can prove it is not. Unless we agree to this, you may not cede (transfer) or pledge (promise) any of your rights or delegate (transfer) any of your duties under your and our agreement. While we may give you extra time to comply with your obligations or decide not to exercise some of our rights, you must not assume that this means that our agreement with you has been changed or that it no longer applies to you. We can still insist on the strict application of any or all of our rights at a later stage. Every clause of the agreement and rules is severable from the others. If one or more of the clauses is invalid it will not mean the rest of the agreement/rules are invalid. The rest of the agreement and rules will still apply. The headings in clauses in our agreement and rules are included for your reference only and must be not be used to interpret the agreement or rules. Unless it is clear from the context, in the rules and this agreement a reference to the singular includes the plural and vice versa. If you live outside the common monetary area (South Africa, Namibia, Swaziland, and Lesotho) additional rules apply to you. See our nonresident terms & conditions. The words including or include must be read as including, but not limited to. For purposes of interpreting the agreement or any rules any reference to FNB includes its successors and assigns, and any of its officers, agents, staff and authorised representatives acting on its authority. We may end this agreement at any time by giving you reasonable notice of this. We can change the terms and conditions that apply to you, the way you access your accounts, any services we provide. We can also add new rules, products or stop existing products at any time. We will only notify you of material changes and unless you cancel this agreement before the date on which the changes take effect, you will be bound to them. No changes to this agreement or any rules and no waiver (giving up) of any of our rights will be binding on us unless it is recorded in writing and signed or issued by our authorised representatives. If the law allows, we have the right, without notice to you, to combine any or all accounts that you may have with us and to set off any amount that you owe us against any amount you have in any of your accounts. However, we reserve the right to combine only some of your accounts and then we will be entitled to claim from you any amount for an account that has not been combined. In addition to this agreement, you will continue to be bound by any tacit (unspoken or implied) agreement between you and us about any account, the common law and by the present-day customs, procedures, practices and usage existing among bankers. Unless we say otherwise South African law will govern our relationship, the terms and conditions and rules without giving effect to any conflict of law provisions. Terms and Conditions: Customer Protection Plan The FNB Personal Loan Customer Protection Plan (the or this "Plan") is subject to the terms, conditions and exclusions set out in this document. 1. Who is the insurer? FirstRand Life Assurance Limited ("FirstRand Life") is the insurer and FNB Life is the administrator of the Plan. Any reference to "we, us, our, ourselves" in this document shall mean FirstRand Life or FNB Life, as the case may be. 2. Who is covered under the Plan? The insured person as listed in the Quotation for a FNB Student Loan, referred to as "you, your, yourself", who entered into a valid Credit Agreement (the "Credit Agreement") with FNB Loans ("FNB Loans"). You are only covered for the benefits set out in these Terms and Conditions. 3. What risks are you covered for? Your cover is based on the disclosure of your employment status at date of application for this Plan. In the case of your Death or Permanent Disability, the outstanding balance of your total obligations under the Credit Agreement will be settled. If you become Temporarily Disabled, all your obligations under the Credit Agreement that become due and payable for a period of 12 months from the date you became Temporarily Disabled, for the Remaining Repayment Period of the Credit Agreement or until you are no longer Temporarily Disabled, whichever is the shorter period. You will be allowed to make multiple claims for Temporary Disability for the duration of your Plan. However, the claims made must not be related to the same Temporary Disability event. If you become Unemployed or if you are Unable to Earn an Income during the period of insurance, other than as a result of Permanent or Temporary Disability, all your obligations under the Credit Agreement that become due and payable for a period of 12 months from the date you became Unemployed or Unable to Earn an Income, during the Remaining Repayment Period of the Credit Agreement or until you are able to become employed or are able to earn an income, whichever is the shorter period. You will be allowed to make multiple claims for being Unemployed or Unable to Earn an Income for the duration of the Plan. However, the claim must not be related to the same Unemployment or Inability to Earn an Income event and must not be with the same employer. We are entitled to request confirmation of your employment or medical status as we deem fit at any time in any form to confirm your continued Unemployment or Temporary Disability. If we pay a claim for Temporary Disability or Unemployment/Inability to Earn an Income, we will waive your

9 monthly premium for the period where the benefit is paid for by us. We will pay the amounts on the due dates of the instalments, starting on the first due date after the date when the claim arose. 4. Covered risk event definitions Disability means you becoming physically or mentally impaired, whether totally or partially, or temporarily or permanently, such that your ability to earn an income or meet the obligations under the Credit Agreement is impaired, and includes, but is not limited to, Occupational Disability. This can either be: Permanent or Permanently means Disability that is irreversible and continuous; Temporary or Temporarily means Disability that lasts for more than a month but is not Permanent. Occupational Disability means a form of disability where your impaired ability to earn an income or meet the obligations under the Credit Agreement arises from a physical or mental impairment, which renders you unable to continue your employment, own occupation, profession or trade. Unable or Inability to earn an income means you are incapable of earning an income from any occupation, work, job or business for any reason other than Disability. Unemployed or Unemployment means you are not employed or engaged in any occupation, work, job or business for remuneration or profit. Retrenchment means your forced termination from employment under section 189 and/ or 189A of the Labour Relations Act, in respect of adverse business conditions, the liquidation of the company, the introduction of new technology and the re-organisation of the business resulting in staff reductions. You shall be regarded as retrenched if you remain unemployed. Self-employed means your primary income is earned from being a sole proprietor, or partner in a firm or association, or a member of a close corporation, or a director of a company, or a trustee of a trust, or you are employed in a family-owned business. Pensioner means you are permanently retired from the workforce or any occupation or profession that provides your primary income, and you qualify to receive a pension which is paid from a pension fund or provident fund, or you qualify to receive an older person s grant. Remaining Repayment Period means the amount of time in which instalments are still payable based on the duration of the Credit Agreement. This is calculated from the date of the claim event. 5. What are the exclusions (when you will not be covered)? We will not pay any amount, including benefits or refund of premiums, on: Death or Disability if: o Wilful self- inflicted injury or suicide within 12 months from the Start Date of this Plan; or o Active participation in war, invasion, acts of foreign enemies, hostilities, warlike operations (whether war be declared or not), civil war, insurrection, rebellion revolution, civil commotion or uprisings, military power; or o Any pre -existing condition/s that you were aware and that affected you within 12 months prior to the Start Date of this Plan, for a period of 12 months after the Start Date of the Plan; and o Disability that arose within 3 months of the Start Date of this Plan. Unemployment or Inability to Earn an Income resulting from: o Retrenchment or termination of employment within 3 months after the Start Date of this Plan, where the term of the Credit Agreement is more than six months; o Lawful dismissal, including dismissal as a result of wilful misconduct that is a violation of some established, definite rule of conduct, a forbidden act, wilful dereliction of duty or misconduct; o Voluntary forfeiture of salary, wages, or other employment income; o Voluntary retrenchment or termination of employment; o Resignation; o Retirement; o Participation in an unprotected strike; and o Retrenchment of which you were aware of or received notice of during the 3 months prior to the Start Date of this Plan. If you are Self-employed, or employed in the informal sector on the Start Date of this Plan, you will not have cover for: o Unemployed or Unable to Earn an Income; and o Occupational Disability. If you become a Pensioner after the Start Date of this Plan, you must notify us to remove the following benefits as they will no longer apply to you: o Unemployed or Unable to Earn an Income; and o Occupational Disability. Any covered event if: o The terms and conditions of this Plan are not met; or o Any information provided upon taking out this Plan and the Credit Agreement, or updating any of the Plan details, or the submission of a claim, is materially incorrect, fraudulent, misrepresented or omitted. We also reserve our rights to recover any amount paid on a claim, which later transpires to have been a fraudulent claim. 6. When does the cover and Plan start? The Plan and your cover start (the "Start Date") when the loan amount has been paid out to you under the Credit Agreement. 7. When does the cover and Plan end? The Plan and all cover ends: When the outstanding balance under the Credit Agreement is settled; When the Plan is cancelled; When you are in arrears by more than one full premium on the Plan. The Bank may pay unpaid premiums on your behalf at its sole discretion, and recover such payments from you. Where the Bank cannot pay the unpaid premiums for any reason whatsoever, the Bank will notify you by SMS/ MMS of the unpaid premium and give you time to rectify this on or before your next loan instalment payment is due. The Bank will notify you by SMS/ MMS when the Plan and all cover has ended and cannot be re-instated. All monies received after the Plan has ended, will be allocated to paying off your loan. On the date of your Death; When a claim is paid on your Death or Permanent Disability.

10 Cancellation: Either party can end the Plan telephonically or in writing by giving a 30 day notice. You will have to provide a suitable replacement credit life insurance policy if you want to cancel this Plan. 90 day cooling off period: You may cancel the Plan in the first 90 days from its start date and receive a full refund of any premium paid, if you have not claimed (this is known as the cooling-off period ). Thereafter, you may cancel this Plan by giving a 30 day notice, without any refund. 8. What you must pay? You must pay the premium amount in accordance with the FNB Student Loans Quotation. FNB will collect your premiums monthly on your behalf from your loan account, and pay it to us when they are due. 9. How and when to make a claim? Notification and submission: The claimant (you or a family member or appointed executor) must notify us of a claim as soon as possible after the claim event occurs. The claim event occurs: on the date of your Death; on the date you are diagnosed by a medical practitioner to be Disabled; or on the date you become Unemployed or are Unable to Earn an Income. The claimant must submit a claim, within 12 months after the claim event occurring. If the claimant doesn't do this, the claim will prescribe and we shall not be liable to pay any benefits under this Plan for such claim. Notification can be done telephonically or by to FNB Loans at the contact details provided in the Credit Agreement or to us at telephone number , fnblifeclaims@fnb.co.za,. Documentation: You can request claim forms, documents or information from FNB Loans or from us at the contact details provided above. The claimant must Complete and sign any claim form we need before we can begin with the claim; Give us all evidence and information we may need to make a decision on a claim; Give us any extra evidence or information we may need at any time; and Bear the cost of getting this evidence and information. This includes the cost of certified translations of evidence and information in a language other than an official language of South Africa, and the cost of evidence and information needed from outside the borders of South Africa. Conditions: If you are diagnosed with a condition, illness or injury, you need to undergo reasonable medical treatment by appropriate medical practitioners (a qualified medical specialist supervising your care for that specific condition, illness or injury). This is needed to reasonably prevent a claim event from happening. If a claim needs to be made, we may also need you to see a medical practitioner of our choice to give us extra evidence and information. We will pay the costs of such a medical practitioner. We will only pay the claim when all evidence and information has been accepted by us. If we reject your claim: You have 90 days to lodge your objection in writing. We will reassess your claim based on any representations made in support of your request for a review and advise you of our final decision in writing. We shall be relieved of liability and a claim shall be deemed to have prescribed should summons not have been served on us within a period of 180 days of receipt of our final decision. This 180 day period is in addition to the 90 days referred to above. 10. General terms and conditions This Plan does not have any surrender or paid up value. This means that if you cancel the Plan, you will not receive any premiums back or any pay out. You also cannot borrow money against this Plan, or use it as security for a loan other than the Credit Agreement Processing of your information: We will process (collect, use, store or otherwise deal with) your personal information and special personal information (as defined in the Protection of Personal Information Act, 2013) ( the Information ) and that of third parties which you provide (like the Information of your family), for the purposes of providing services and products to you. We will also share the Information with financial institutions for the purposes of providing our services and products to you. You must have permission to give the Information of third parties to us and you indemnify us against any and all losses by or claims made against it as a result of you not having the required permission. The Information will be processed in terms of our Privacy Policy (available at and the law. The Information you provide us with is given voluntarily. If you withhold the Information that we request, withhold consent for the processing of the Information or object to the processing of the Information, this may result in us not establishing or continuing a business relationship with you. This may limit your access to our services and products. Changes to the Plan: You can cancel a change to the Plan within 90 days months of making it. We shall refund any additional premium paid as a result of that change if you haven t claimed. Reviews and Cancellations by us: We have the right to change or cancel the Plan and/or the premiums you must pay if the law permits us to, including changes relating to legislation or other rules applicable to this Plan. We will notify you via post, SMS, or any other means within 30 days of any such change being implemented. We may immediately cancel this Plan or place it on hold, refuse any transaction or instructions, or any other action that we consider necessary in order to comply with laws and prevent or stop undesirable or criminal activity. Applicable law: Any legal issues will be decided in accordance with South African Law. Disclosure of material facts: It is your obligation to accurately and properly disclose all material facts to us. If any of the information or statements that you give us is wrong or if you did not give us the relevant information when starting, or updating your Plan, we have the right to: Change the Terms and Conditions of your Plan; Cancel your Plan from any date that we choose and to keep your premiums for the cover you had until the date of cancellation;
