7 Case KG Doc 448 Filed 11/14/18 Page 7 of 18 pursuant to the Administrative Order with respect to the sums of $25, (80% of $32,453.50) as compensation and $ for reimbursement of actual and necessary expenses, for a total of $26,656.13, for the period from October 1, 2018 through and including October 31, 2018 (the Compensation Period ). In support of this Application, WTP respectfully represents as follows: Background 1. On July 29, 2018 (the Petition Date ), the above-captioned debtors and debtors in possession (collectively, the Debtors ) filed voluntary petitions with this Court for relief under chapter 11 of the Bankruptcy Code. The Debtors manage and operate their business as debtors in possession under sections 1107(a) and 1108 of the Bankruptcy Code. On July 31, 2018, this Court entered an order directing joint administration of the Debtors chapter 11 cases for procedural purposes only pursuant to Bankruptcy Rule 1015(b) and Local Rule [Docket No. 37]. 2. On August 8, 2018, the Office of the United States Trustee for the District of Delaware (the U.S. Trustee ) appointed the Official Committee of Unsecured Creditors (the Committee ), consisting of the following three members: (i) FBI Wind Down Inc. Liquidating Trust; (ii) Hickory Spring Manufacturing Company; (iii) EKH Furniture Industries, Ltd.; (iv) Piedmont Packaging; (v) International Market Centers, LLC [Docket No. 87]. 3. That same day, the Committee selected Foley & Lardner LLP, as its lead counsel and WTP as its co-counsel. The Committee also selected Province, Inc. as its financial advisor. 4. On September , the Court entered the Order Granting Application of Official Committee of Unsecured Creditors of Heritage Home Group LLC, et al., for Entry of an Order Authorizing the Employment and Retention of Whiteford, Taylor & Preston LLC as Co- Counsel Nunc Pro Tunc to August 8, 2018 [Docket No. 303] v1 2

8 Case KG Doc 448 Filed 11/14/18 Page 8 of 18 Compensation Paid and its Source 5. All services for which compensation is requested by WTP were performed for or on behalf of the Committee. 6. WTP has received no payment and no promises for payment from any source for services rendered or to be rendered in any capacity whatsoever in connection with the matters covered by this Application. There is no agreement or understanding between WTP and any other person other than the Partners of WTP for the sharing of compensation to be received for services rendered in these cases. Fee Statement 7. The fee statement for the Compensation Period is attached hereto as Exhibit A. This statement contains daily time logs describing the time spent by each attorney and paraprofessional for the Compensation Period. To the best of WTP s knowledge, this Application complies with Sections 330 and 331 of the Bankruptcy Code, the applicable Bankruptcy Rules, Local Rule , applicable Third Circuit law and the Administrative Order. Actual and Necessary Expenses 8. A summary of actual and necessary expenses and daily logs of expenses incurred by WTP during the Compensation Period is attached hereto as Exhibit B. WTP charges all of its bankruptcy clients $0.10 per page for photocopying expenses and $0.10 per page for printing. Actual long-distance carrier charges for outgoing facsimile transmissions are reflected in the long-distance telephone charges. 9. Regarding providers of on-line legal research (e.g., LEXIS and WESTLAW), WTP charges all of its clients a pro-rated rate relative to the standard usage rates these providers charge, v1 3

9 Case KG Doc 448 Filed 11/14/18 Page 9 of 18 which, due to contractual flat fees, may not always equal WTP s actual cost. WTP currently is under contract to pay these providers a flat fee every month. Charging its clients a pro-rated rate of the on-line providers standard usage rates allows WTP to still provide a discount to its clients and cover adequately the monthly flat fees it must pay to these types of providers. 10. WTP believes the foregoing rates are the market rates that the majority of law firms charge clients for such services. In addition, WTP believes that such charges are in accordance with the American Bar Association s ( ABA ) guidelines, as set forth in the ABA s Statement of Principles, dated January 12, 1995, regarding billing for disbursements and other charges. Summary of Services Rendered 11. The WTP attorneys who have rendered professional services in these cases are as follows: Kevin G. Hroblak, Christopher M. Samis, L. Katherine Good, Stephen B. Gerald and Aaron H. Stulman. The paraprofessionals who have provided services to these attorneys in these cases are as follows: Cynthia McMenamin and Lauren Huber. 12. WTP, by and through the above-named persons, has prepared and/or assisted in the preparation of various applications and orders submitted to the Court for consideration, advised the Committee on a regular basis with respect to various matters in connection with these cases and has performed all necessary professional services, which are described and narrated in detail hereinafter. Summary of Services By Project 13. The services rendered by WTP during the Compensation Period can be grouped into the categories set forth below. These categories are generally described below, with a more detailed identification of the actual services provided set forth on the attached Exhibit A. The attorneys and paraprofessionals who rendered services relating to each category are identified, v1 4
