4 Agreement I, the person signing this Credit Account Application form, warrant and represent on behalf of the Applicant, and the Applicant warrants and represents, to Data Select Limited that: 1. I am duly authorised on behalf of the Applicant to sign this Credit Account Application form and the Applicant hereby applies to open a trade credit account with Data Select Limited; and 2. the Applicant/I have read, understood and accept the attached Data Select Limited Terms and Conditions of Trade; and 3. I understand, and the Applicant understands, that the attached Data Select Limited Terms and Conditions of Trade: a. shall govern all contracts and dealings between the Applicant and Data Select Limited in relation to the purchase of goods by the Applicant from Data Select Limited to the exclusion of any other terms and conditions subject to which any such order is made or purported to be made by the Applicant; and b. may be amended from time to time by Data Select Limited in accordance with its terms; and 4. the Applicant consents to Data Select Limited obtaining any: a. business credit information as may be required to from time to time in connection with this Credit Account Application form, including, but not limited to, any renewal, extension or amendment thereof and that the Applicant further consents to the disclosure of any information to any person with whom the Applicant has, or at any time proposes to have, financial relations; and b. credit checks on the Applicant s shareholders, owners and directors as Data Select Limited may, in its absolute discretion, determine as being necessary in relation to this Credit Account Application; and 5. the Applicant will pay and discharge all amounts owing by the Applicant to Data Select Limited within 30 (thirty) days of the date of Data Select Limited s invoice in respect of the same.
